APPEAL – Owner Elizabeth Dacosta vs. First Instance Tribunal
On Friday February 17, 2023, the Commission heard an appeal submitted by Owner, Mrs. Elizabeth Dacosta against the decision of the First Instance Tribunal in relation to Photo Finish and Dead Heat of the 9th Race on the 8th May, 2021.
After carefully reviewing the evidence and submissions made by attorneys –at- Law Mr. Jeffery Mordecai and Mr. Gordon Robinson, representative of Mrs. Dacosta; SVREL’s legal representatives, Ms. Katherine Francis and attorney –at- law Walter Scott KC along with the Commission’s legal representative, Mr. Garth McBean KC, the Commission ruled that the decision of the First Instance Tribunal be upheld.
Therefore, the final placings of the race remain as was, first passed the post Miniature Man and Further and Beyond ending in a dead heat.
